Welcome to Shelbi Creates (shelbicreates.com). By accessing or using this website, you agree to be bound by the following terms and conditions. Please read them carefully before making a purchase or using our services.

Separate written agreements supersede these Terms. If you enter into a custom commission, collaboration, or other written agreement with Shelbi Creates for a specific project, that agreement controls over anything stated here for that engagement. These Terms apply where no separate agreement is in place.

1. Eligibility & General

These Terms & Conditions govern your use of the Shelbi Creates website and all products and services offered through it. You must be at least 18 years old to make a purchase. By placing an order, you confirm that you are at least 18 years old and that you accept these terms in full.

2. Electronic Communications

By making a purchase, submitting our contact form, or otherwise interacting with this website, you consent to communicate with Shelbi Creates electronically, primarily via email. Email is our official channel for receipts, order updates, support, and other notices related to your purchase.

3. Use of AI Tools

Shelbi Creates uses AI tools (including large language models such as Claude and related platforms) as part of building and maintaining this website and in limited creative and administrative tasks. Original artwork is created by Shelbi Cox. Human judgment and oversight are applied throughout, and customer information is handled with care.

4. Products & Descriptions

We make every effort to display our products (original art, prints, stickers, mugs, journals, apparel, and more) as accurately as possible. However, colors may vary slightly due to differences in monitors, screens, and printing processes. Product descriptions are provided for informational purposes and do not constitute a warranty.

5. Orders & Payment

• All orders are processed through our Etsy storefront. Payments are handled securely via Etsy's payment processing.
• Prices are listed in USD and are subject to change without notice.
• We reserve the right to cancel or refuse any order at our discretion, including orders that appear fraudulent.
• You will receive an email confirmation once your order has been placed and another when it ships.

6. Chargebacks & Payment Disputes

If you have a concern about a charge, please contact us through our contact form first so we can look into it and try to resolve it directly. In most cases we can sort things out quickly.

By making a purchase, you agree not to file a chargeback, payment dispute, or reversal with your bank, card issuer, or Etsy without first giving us a reasonable opportunity to address the issue. Chargebacks filed without contacting us first may result in revoked access to digital downloads and recovery of disputed amounts and related fees.

7. Shipping & Fulfillment

• Most print-on-demand products (stickers, mugs, apparel) are fulfilled through Printful and ship directly from their facilities.
• Original art pieces and select items ship directly from Shelbi Creates.
• Shipping times vary by product type and destination. Estimated delivery windows are provided at checkout.
• Shelbi Creates is not responsible for delays caused by carriers, customs, or weather events.

8. Returns & Refunds

• Original art: Due to the unique nature of original artwork, all sales are final. Please reach out if your item arrives damaged and we will work with you.
• Print-on-demand products: Returns and replacements for defective or damaged items are handled in accordance with Printful's return policy. Please contact us within 14 days of delivery.
• Digital products: All digital product sales are final and non-refundable.

9. Digital Downloads & Right to Revoke Access

Digital products (such as digital art prints) are delivered electronically through Etsy after purchase. Please download and save your own copy as soon as possible after purchase. We reserve the right to revoke access to digital downloads, without refund, if we determine in good faith that a file has been redistributed, resold, or used in violation of these Terms, or if a payment is reversed, charged back, or otherwise not honored.

10. Intellectual Property & Copyright Notice

All content on this website — including but not limited to all original artwork, illustrations, designs, prints, images, text, logos, graphics, and the overall design and layout of this website — is the sole intellectual property of Shelbi Creates (Shelbi Cox) and is protected by U.S. and international copyright laws.

You may not, without prior written permission from Shelbi Creates:

• Reproduce, copy, or duplicate any artwork or designs, in whole or in part, in any medium
• Distribute, sell, resell, or commercially exploit any content from this website
• Modify, create derivative works from, or adapt any artwork or designs
• Use any artwork, images, or designs for personal projects, commercial purposes, or social media without proper licensing or written consent
• Remove, alter, or obscure any copyright notices, watermarks, or proprietary markings

Purchasing a product does not transfer copyright or intellectual property rights. You are purchasing a physical or digital copy for personal use only. Unauthorized use of any content may result in legal action.

11. User Conduct

You agree not to use this website for any unlawful purpose, to interfere with the site's operation, or to attempt unauthorized access to any part of the site or its systems.

12. Disclaimer & Release of Liability

This website and all products are provided "as is" and "as available," without warranties of any kind, whether express or implied, to the fullest extent permitted by law. While a lot of care goes into every piece of artwork and every listing, colors, textures, and finishes can vary between monitors, screens, and printing runs, and we make no guarantees that a product will exactly match what you see online.

To the maximum extent permitted by law, Shelbi Creates and Shelbi Cox will not be liable for any indirect, incidental, consequential, special, or punitive damages arising from your use of this website or the purchase of any product. Our total liability for any claim is limited to the amount you actually paid for the specific product giving rise to the claim.

13. Updates & Ongoing Maintenance

We reserve the right to update, revise, change, or discontinue any part of this website, product catalog, pricing, or service at any time without notice. We make reasonable efforts to keep information accurate and current, but release liability for any portion of the site or product listing that becomes outdated, inaccurate, or unavailable due to changes in third-party platforms (such as Etsy or Printful) or other circumstances.

14. Force Majeure

We are not responsible for delays or failures in processing orders, fulfilling products, or providing any other service caused by events outside our reasonable control. This includes, but is not limited to, illness or medical emergencies, natural disasters, power or internet outages, carrier delays, customs, and hosting or third-party platform failures (such as Etsy, Printful, Netlify, or similar providers). In any such event, we will make reasonable efforts to communicate and resume service as soon as reasonably possible.

15. Third-Party Services

This website may contain links to third-party sites (Etsy, Printful, social media platforms). We are not responsible for the content, privacy policies, or practices of any third-party services. Your use of Etsy for purchases is also subject to Etsy's own terms of use.

• Right to decline or end service. We reserve the right to decline or end service, cancel or refuse any order, and revoke access to digital downloads at our discretion, including (but not limited to) cases of abuse, misuse, non-payment, chargeback, or violation of these Terms.

19. Governing Law

These Terms & Conditions are governed by and construed in accordance with the laws of the State of Texas, United States, without regard to its conflict of law provisions. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts located in Texas.

20. Dispute Resolution

In the event of a dispute, you agree to first attempt to resolve it informally by contacting us through our contact form. If the dispute cannot be resolved informally within 30 days, either party may pursue formal legal remedies as permitted under governing law.

21. Changes to These Terms

We reserve the right to update these Terms & Conditions at any time. Changes will be posted on this page with an updated date. Continued use of the website after changes constitutes acceptance of the revised terms.
